PolyChat Terms of Service

I. Agreement to These Terms

  1. These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and PolyChat Team ("PolyChat," "we," "us," or "our") governing your access to and use of the PolyChat application, accounts, community, communications, and related services (collectively, the "Service").
  2. These Terms work together with the PolyChat Custom End User License Agreement (EULA), the Community Guidelines in Section VI, and the Privacy Policy. The EULA controls matters concerning the software license. The Privacy Policy controls the handling of personal data. These Terms control accounts, Service use, UGC, user conduct, safety, and community participation.
  3. Before registering for or logging in to PolyChat, you must be presented with and review the EULA, these Terms, the Community Guidelines, and the Privacy Policy. The consent control is not selected by default, and you cannot continue until you affirmatively agree. We record the user or account identifier, the agreement version, and the time of acceptance. Material updates may require renewed acceptance.
  4. If you do not agree to these Terms, do not register for, log in to, access, or use the Service.

II. Eligibility and Age Requirement

  1. You must be at least 18 years old to register for or use PolyChat. The Service is not directed to minors.
  2. By using the Service, you represent that you are at least 18 years old, have legal capacity to agree to these Terms, and are not prohibited from using the Service under applicable law.
  3. We may request reasonable age confirmation and may restrict or terminate an account if we reasonably believe the user is under 18.

III. Account Registration and Security

  1. You must provide accurate, current, and complete registration information and keep it updated.
  2. You are responsible for safeguarding your credentials and for activity conducted through your account. Notify us promptly at polychatsupport@polychat.site if you suspect unauthorized access.
  3. You may not impersonate another person, use misleading account information, sell or transfer an account, create accounts through unauthorized automated means, or obtain another person's account.
  4. A permanently banned user may not create or obtain another account through a different name, device, credential, or another person. We may use proportionate account and technical information to enforce this restriction.

IV. Use of the Service

  1. You may use PolyChat only for lawful, personal, and non-commercial purposes unless we expressly authorize another use.
  2. You may not interfere with the Service, probe or bypass security or moderation systems, introduce malicious code, scrape or harvest data, send spam, conduct fraud, reverse engineer restricted components, or use the Service to violate another person's rights.
  3. You must comply with applicable device, platform, wireless-data, internet, and third-party service terms when using PolyChat.

V. User-Generated Content and Content License

  1. "User-Generated Content" or "UGC" includes usernames, profile information, biographies, avatars, posts, comments, messages, images, audio, video, reports, and other material submitted through the Service.
  2. You retain ownership of your UGC. You are responsible for your UGC and must have the rights and permissions necessary to submit it.
  3. You grant PolyChat a worldwide, non-exclusive, royalty-free, limited, and sublicensable license to host, store, reproduce, process, transmit, display, moderate, filter, review, and distribute your UGC only as reasonably necessary to operate, provide, secure, improve, and enforce the Service. Sublicensing is limited to service providers and contractors acting for those purposes.
  4. PolyChat will not use your UGC for advertising or marketing without separate permission.
  5. When you delete UGC or delete your account, the license to display and use that UGC for other users ends promptly. Limited copies or records may be retained when reasonably necessary for safety review, dispute resolution, legal compliance, fraud prevention, enforcement, and routine backups as described in the Privacy Policy.

VI. Community Guidelines and Zero-Tolerance Policy

  1. PolyChat has zero tolerance for objectionable content and abusive users. You must treat other users with respect and may not create, upload, transmit, request, promote, or facilitate objectionable content or abusive conduct.

  3. An "abusive user" includes anyone who engages in prohibited conduct, repeatedly violates these Guidelines, evades enforcement, or uses the Service to harm, threaten, exploit, deceive, or harass another person.

VII. Filtering and Moderation

  1. PolyChat uses automated filtering, risk controls, and human moderation to detect and prevent objectionable content.
  2. UGC intended for public or community display, including usernames, biographies, avatars, posts, comments, uploaded images, and uploaded video, is not made visible to other community users until it completes the applicable moderation review, even if the submitting user's device shows that creation or upload succeeded.
  3. Automated systems and human moderators continue reviewing content after publication. Content identified as prohibited will be promptly restricted or removed, and the responsible account will be subject to enforcement.
  4. Private messages are automatically filtered and may be delivered in real time after automated checks. They remain subject to subsequent automated and human safety review. PolyChat may block, restrict, or remove a message and take enforcement action when a violation is detected.
  5. Video and live-communication features provide controls to end an interaction, report content or a user, and block a user. Reported conduct may be reviewed using the minimum evidence reasonably necessary to assess the report.
  6. Filtering and moderation reduce risk but cannot guarantee that every violation will be detected before exposure. Use the in-app report, block, and end-interaction controls immediately if you encounter unsafe conduct.

VIII. Reporting and Blocking

  1. You can report specific content and specific users through the in-app reporting controls available in relevant content, profile, messaging, and communication interfaces.
  2. A report may include the reporter's and reported user's identifiers, a content or conversation identifier, a copy of the reported content, the report reason and time, limited surrounding messages necessary for context, evidence voluntarily provided by the reporting user, and limited security diagnostics.
  3. The reporting feature does not automatically record or store live audio or video and does not automatically capture live video-call images.
  4. You can block abusive users through the in-app controls. Blocking immediately removes the blocked user's content from your feed, chat views, comments, search results, recommendations, and matching experience, as applicable, and prevents further interaction to the extent supported by the Service.
  5. Blocking automatically creates a moderation report for PolyChat so that the associated account and relevant inappropriate content or conduct can be reviewed.
  6. PolyChat will review reports and take appropriate action within 24 hours. When objectionable content or abusive conduct is confirmed, PolyChat will remove or disable the offending content and remove the responsible user from the Service through suspension or permanent termination.

IX. Enforcement and Appeals

  1. PolyChat may prevent publication, reduce distribution, restrict features, remove content, preserve evidence, suspend or terminate accounts, prevent re-registration, or report conduct to appropriate authorities when reasonably necessary to enforce these Terms or protect users and the Service.
  2. Severe violations, exploitation of minors, credible threats, sexual exploitation, repeated abuse, or attempts to evade enforcement may result in immediate permanent termination.
  3. You may appeal a content or account decision by emailing polychatsupport@polychat.site. Safety measures may remain in effect while an appeal is pending.

X. Purchases and Subscriptions

  1. If PolyChat offers purchases or subscriptions through the App Store, payment, renewal, cancellation, and refund processing are governed by Apple's applicable terms and your App Store account settings.
  2. Subscription features, billing periods, prices, and renewal terms will be presented before purchase. Unless canceled through your App Store account, an auto-renewable subscription may renew according to the terms shown at purchase.
  3. Deleting a PolyChat account does not automatically cancel an App Store subscription. You should manage or cancel the subscription through your Apple account before or after requesting account deletion.

XI. Intellectual Property

  1. The Service, excluding user-owned UGC, and its software, designs, text, graphics, trademarks, logos, and related intellectual property are owned by or licensed to PolyChat.
  2. Except for the limited rights expressly granted under the EULA and these Terms, no intellectual-property right is transferred to you.
  3. If you believe content in the Service infringes your rights, contact polychatsupport@polychat.site with sufficient information for review.

XII. Privacy

  1. The Privacy Policy explains how PolyChat collects, uses, shares, protects, retains, and deletes personal data.
  2. Safety filtering, moderation, reporting, blocking, and enforcement may require processing account identifiers, UGC, messages, report details, limited context, technical diagnostics, and enforcement records.

XIII. Third-Party Services

  1. The Service may contain links to or integrations with third-party services. Those services may be governed by their own terms and privacy policies.
  2. PolyChat is not responsible for a third-party service except to the extent required by applicable law.

XIV. Availability, Changes, and Security

  1. PolyChat may update, maintain, suspend, restrict, or discontinue features where reasonably necessary for security, legal compliance, technical operation, or product improvement.
  2. We do not guarantee uninterrupted or error-free availability. We use reasonable safeguards but cannot guarantee that unauthorized access, loss, or misuse will never occur.
  3. We may provide security fixes or App updates. Continued operation may require installing a supported version.

XV. Account Termination and Deletion

  1. You may stop using the Service at any time and may initiate deletion of your account through the in-app account-deletion control.
  2. Account deletion removes the account and associated UGC from user-facing systems, subject to limited retention required for safety, enforcement, disputes, legal obligations, fraud prevention, and backup cycles as described in the Privacy Policy.
  3. PolyChat may suspend or terminate access for violation of these Terms. Sections that by their nature should survive termination, including ownership, limited evidence retention, dispute resolution, and liability provisions, will survive to the extent permitted by law.

XVI. Disclaimers and Limitation of Liability

  1. To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties that may lawfully be disclaimed.
  2. To the maximum extent permitted by law, PolyChat is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or loss of profits, revenue, data, goodwill, or opportunity arising from use of or inability to use the Service.
  3. Nothing in these Terms excludes or limits liability, consumer protection, remedies, or statutory rights that cannot lawfully be excluded or limited.

XVII. Responsibility for Violations

  1. You are responsible for losses or claims directly caused by your unlawful UGC, your infringement of another person's rights, or your material violation of these Terms, to the extent permitted by applicable law.
  2. This provision does not require a consumer to waive a non-waivable defense or statutory right.

XVIII. Governing Law and Dispute Resolution

  1. Except to the extent the mandatory law of your place of residence applies, these Terms are governed by California law without regard to conflict-of-law principles.
  2. Before initiating arbitration, either party must give written notice of the dispute and requested relief and allow 30 days for good-faith informal resolution.
  3. Except for the exceptions below and where prohibited by applicable law, unresolved disputes will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The place of arbitration will be San Francisco County, California, the language will be English, and remote participation may be used where permitted.
  4. You may opt out of arbitration by emailing polychatsupport@polychat.site within 30 days after first accepting these Terms. Include your full name, account email or identifier, and a clear statement that you opt out of arbitration.
  5. Either party may bring an eligible individual claim in small-claims court or seek temporary, preliminary, emergency, or intellectual-property injunctive relief in a court of competent jurisdiction.
  6. For matters not subject to arbitration and enforcement of arbitration awards, the parties consent to state and federal courts in San Francisco County, California, unless mandatory law grants a non-waivable right to another forum.
  7. This Section does not remove non-waivable local consumer protections, statutory remedies, or access to courts.

XIX. Changes and Contact

  1. PolyChat may update these Terms to reflect changes in the Service, safety practices, or legal requirements. Material changes will receive reasonable notice and may require affirmative reacceptance. The effective date and version will be updated.
  2. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver.
  3. The English version is the governing version, subject to non-waivable local language requirements.
